By placing an order on Phantom Data ("we", "us", "our"), you ("Customer", "you") agree to the following terms. Please read them carefully before purchasing.

1. Service Description

Phantom Data provides business lead data including but not limited to: business names, owner names, phone numbers, email addresses, and mailing addresses. Data is compiled from publicly available sources and third-party data providers.

2. Data Accuracy

All data is provided "as-is" without warranty of any kind. We do not guarantee the accuracy, completeness, or currentness of any data delivered. Business information changes frequently and some records may contain outdated or incorrect information.

While we strive to deliver high-quality, accurate data, match rates and data completeness vary by industry, location, and data availability. Typical match rates range from 60%–90% depending on the market.

3. Permitted Use

Data purchased through Phantom Data may be used for:

Business-to-business marketing and outreach
Sales prospecting and lead generation
Direct mail campaigns
Market research and analysis

4. Prohibited Use

You agree not to use data purchased from Phantom Data for:

Any illegal, fraudulent, or deceptive purposes
Harassment, threats, or abuse of any individuals
Reselling or redistributing raw data to third parties
Spam or unsolicited communications that violate CAN-SPAM, TCPA, or other applicable laws
Any activity that violates federal, state, or local laws

5. Compliance & Legal Responsibility

You are solely responsible for ensuring your use of purchased data complies with all applicable laws and regulations, including but not limited to the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, state Do-Not-Call lists, and any other federal, state, or local regulations governing marketing communications.

Phantom Data does not provide legal advice. We recommend consulting with a legal professional to ensure your marketing practices are compliant with all applicable laws.

6. Limitation of Liability

To the maximum extent permitted by law:

Phantom Data shall not be held liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of purchased data
Phantom Data is not responsible for any fines, penalties, or legal actions resulting from your use of the data
Our total liability shall not exceed the amount you paid for the specific order in question
Phantom Data is not liable for any lost revenue, lost profits, or business interruption resulting from data inaccuracies

7. Refund Policy

Due to the nature of data products, all sales are final. Once data has been delivered, we cannot issue refunds. If you experience a technical issue with delivery, contact us within 48 hours at hello@phantomdata.io and we will work to resolve it.

8. Indemnification

You agree to indemnify, defend, and hold harmless Phantom Data, its owners, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorney's fees) arising from:

Your use of purchased data
Your violation of these terms
Your violation of any applicable law or regulation
Any third-party claims related to your marketing or outreach activities

9. Privacy

We collect your name, email, and payment information solely to process your order. We do not sell or share your personal information with third parties. Payment processing is handled securely through Stripe.

10. Modifications

We reserve the right to update these terms at any time. Changes take effect immediately upon posting. Continued use of our service after changes constitutes acceptance of the updated terms.

11. Governing Law

These terms are governed by and construed in accordance with the laws of the State of North Carolina, without regard to conflict of law principles.
